Right of withdrawal
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the goods (or the last item, partial shipment, or piece in the case of a contract for multiple items in a single order or the delivery of an item in multiple partial shipments, or the first item in the case of a contract for the regular delivery of goods over a specified period).
To exercise your right of withdrawal, you must inform us (Stiftung Museum Kunstpalast, Ehrenhof 4-5, 40479 Düsseldorf, webshop@kunstpalast.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail or an email).
To comply with the withdrawal period, it is sufficient for you to send notification of your intention to exercise your right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall refund all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the cheapest standard delivery option offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract.
For this refund, we will use the same payment method you used for the original transaction, unless we have agreed on something different with you; in any case, you won’t be charged any fees for this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without delay and, in any event, no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you post the goods before the end of the fourteen-day period.
You are responsible for the direct costs of returning the goods.
You are only liable for any loss in value of the goods if such loss is attributable to handling of the goods that goes beyond what is necessary to assess their nature, characteristics, and functionality.
Scope of Application
This cancellation policy applies exclusively to cases in which you are entitled to a right of cancellation under the statutory provisions. In all other cases, this cancellation policy does not establish a contractual right of cancellation.
